These Terms and Conditions apply to the use of the CL Jewellery website and to purchases of products and services from CL Jewellery.

By using this website, placing an order, or engaging us to provide a product or service, you agree to these Terms and Conditions together with our Returns Policy and Privacy Policy.

“CL Jewellery”, “we”, “us” and “our” refer to C.L. Jewellery Ltd. “You” and “your” refer to the customer or person using this website.

Nothing in these Terms and Conditions limits any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other applicable New Zealand law.

1. Products and Website Information

We take reasonable care to ensure that product descriptions, photographs, specifications, dimensions, gemstone details and pricing displayed on our website are accurate.

As jewellery is photographed at close range, products may appear larger or smaller in photographs than their actual size. Colours may also vary slightly depending on lighting, photography, screen settings and the device being used.

Measurements, carat weights and dimensions may be approximate unless expressly stated otherwise.

We reserve the right to correct genuine errors in product information or pricing. If an error affects an order you have already placed, we will contact you as soon as reasonably possible and provide the appropriate options, including a full refund where applicable.

2. Natural Gemstones

Natural gemstones are unique products of nature. Variations in colour, tone, saturation, inclusions, zoning, clarity and other natural characteristics are normal and form part of the individuality of each gemstone.

Some natural gemstones may have undergone treatments or enhancements that are commonly accepted within the jewellery industry. Treatment information will be provided where available and relevant.

We make every reasonable effort to represent gemstone colours accurately. However, the appearance of coloured gemstones can change under different lighting conditions, and colours may appear different when viewed on different screens.

These natural variations are not considered faults or defects.

3. One-of-a-Kind Jewellery and Availability

Many CL Jewellery pieces contain unique natural gemstones and are therefore one-of-a-kind.

All products are subject to availability. An item may occasionally be sold through another sales channel before our website has been updated.

If you purchase an item that is no longer available, we will contact you as soon as possible and provide a full refund of any amount paid.

A sold gemstone or completed one-of-a-kind ring may not be available again in exactly the same colour, dimensions, appearance or specifications.

4. Orders

Submitting an order through our website constitutes an offer to purchase the selected product or service.

We reserve the right to accept or decline an order where reasonably necessary, including where:

  • a product is unavailable;
  • an incorrect price or product description has been displayed;
  • payment cannot be verified;
  • we reasonably suspect fraudulent activity; or
  • we are otherwise unable to fulfil the order.

If we decline an order after payment has been received, the amount paid will be refunded.

5. Pricing and Payment

Unless otherwise stated, prices displayed on our website are in New Zealand dollars and include GST where applicable.

Any applicable delivery charges will be shown before checkout or otherwise advised to you before payment.

Payment methods available may include credit/debit card, Afterpay or other payment methods offered by CL Jewellery from time to time.

We reserve the right to change our prices at any time. Any price change will not affect an order that we have already accepted, except where there has been an obvious pricing or technical error.

6. Bespoke and Custom-Made Jewellery

CL Jewellery offers bespoke and custom-made jewellery services.

A bespoke order may include, but is not limited to:

  • custom-designed rings or jewellery;
  • jewellery made to a customer's requested specifications;
  • jewellery made to a particular ring size;
  • custom gemstone selection;
  • CAD or design work;
  • engraving;
  • customised gemstone setting;
  • alterations to an existing design; or
  • other personalised work agreed between CL Jewellery and the customer.

Deposits

A deposit may be required before we reserve a gemstone, begin CAD or design work, order materials or commence production.

The required deposit amount and payment terms will be stated in your quotation, invoice or order confirmation.

Once design work, gemstone reservation, sourcing or production has commenced, deposits for bespoke work may be non-refundable to the extent permitted by law because costs may already have been incurred specifically for your order.

This does not affect any rights you may have where goods or services fail to meet the guarantees required by New Zealand consumer law.

Design Approval

Where a CAD drawing, design drawing, rendering or other design confirmation is provided, you are responsible for reviewing the design carefully before approving it.

Please check relevant details including:

  • ring size;
  • dimensions;
  • gemstone arrangement;
  • metal;
  • engraving;
  • general design and proportions.

Once a design has been approved and production has commenced, further changes may incur additional costs and may affect the completion timeframe.

We will advise you of any additional cost before proceeding with a requested change.

Ring Size

It is the customer's responsibility to provide or approve the correct ring size before production.

We are happy to provide guidance on sizing; however, finger size can vary due to temperature, time of day and other factors.

If a completed bespoke ring requires resizing because an incorrect size was supplied or approved by the customer, resizing charges may apply.

Some designs, including full eternity bands, intricate settings or rings containing certain gemstones, may have limited resizing options.

Natural Gemstones in Bespoke Jewellery

Where a particular natural gemstone has been selected and approved for a bespoke order, its natural inclusions, colour characteristics and variations form part of the selected gemstone and are not considered defects.

Completion Timeframes

Any production or completion timeframe we provide is an estimate unless we expressly agree otherwise in writing.

Delays can occasionally arise due to gemstone cutting, casting, manufacturing, material availability, valuation services, courier delays or circumstances beyond our reasonable control.

We will keep you reasonably informed if a significant delay occurs.

Final Payment

Unless otherwise agreed, the outstanding balance for a bespoke order must be paid in full before the completed jewellery is dispatched or released to the customer.

7. Change-of-Mind Returns

At CL Jewellery, your satisfaction is our priority. We want you to feel confident and happy with your purchase.

We offer a 7-day return period on eligible non-bespoke items.

If you change your mind, you are welcome to return an eligible item within 7 days of delivery, provided that it is:

  • unworn;
  • unused;
  • undamaged; and
  • returned in pristine condition with any original packaging and documentation where applicable.

For eligible change-of-mind returns, we are happy to offer an exchange or store credit.

Cash refunds are not available for change-of-mind purchases.

Bespoke, custom-made, engraved, altered or specially ordered items are not eligible for change-of-mind returns.

Nothing in our change-of-mind policy affects your rights under the Consumer Guarantees Act 1993.

8. Faulty or Defective Products

Our products are supplied subject to the guarantees provided by New Zealand consumer law, including the Consumer Guarantees Act 1993.

If you believe an item is faulty or defective, please contact us as soon as reasonably possible so that we can assess the item and assist you.

Depending on the circumstances and your rights under applicable law, an appropriate remedy may include repair, replacement or refund.

Our voluntary warranty and change-of-mind policies are in addition to, and do not replace, your statutory consumer rights.

9. Jewellery Warranty and Care

Unless otherwise stated, CL Jewellery provides a 12-month limited warranty against manufacturing defects in materials or workmanship from the date of purchase.

Proof of purchase may be required.

The warranty does not cover damage or deterioration caused by matters including:

  • normal wear and tear;
  • accidental damage;
  • impact or crushing;
  • improper use or care;
  • loss or theft;
  • loss of a gemstone caused by damage or wear;
  • alteration or repair performed by another jeweller;
  • chemical exposure;
  • damage caused by activities inappropriate for fine jewellery; or
  • failure to maintain the jewellery appropriately.

We will assess warranty claims reasonably and determine whether the issue is a manufacturing defect or is the result of wear, damage or another excluded cause.

White gold jewellery may be rhodium plated. Rhodium plating naturally wears over time and periodic replating is considered normal maintenance rather than a manufacturing defect.

Nothing in this warranty excludes or limits your rights under the Consumer Guarantees Act 1993.

10. Jewellery Care and Maintenance

Fine jewellery requires appropriate care and maintenance.

Claws, settings and stones can be damaged through impact, heavy lifting, gym activities, manual work or other activities involving significant pressure on the jewellery.

We recommend periodically checking jewellery for wear, loose stones and damaged settings and having appropriate maintenance carried out when required.

Normal maintenance and wear are not manufacturing faults.

11. Delivery

We deliver orders using NZ Post or another suitable delivery provider selected by CL Jewellery.

Delivery services and charges will be displayed at checkout or advised before dispatch.

Where applicable, orders may be sent using a tracked and signature-required service.

Estimated courier delivery times are provided as a guide only. Once an order has been dispatched, courier delays may occur that are outside our reasonable control.

If you provide authority to leave, alternative delivery instructions, or request delivery without a signature, responsibility for the parcel may pass to you once the courier has completed delivery in accordance with those instructions.

Please ensure that the delivery address provided with your order is accurate.

12. Valuation Certificates

Where a valuation certificate is included with or purchased for an item, the valuation may be completed by an independent jewellery valuer.

Valuations represent the professional opinion of the valuer at the time of valuation and may differ from the purchase price.

A valuation does not guarantee a future resale value or investment return.

13. Promotions, Discounts and Vouchers

Promotional offers, discount codes and vouchers may be subject to additional terms and expiry dates.

Unless otherwise stated:

  • promotional codes cannot be exchanged for cash;
  • only one promotional code may be used per transaction;
  • promotional offers cannot necessarily be combined; and
  • discounts may exclude selected products or services.

We reserve the right to amend or withdraw promotions where reasonably necessary, provided this does not affect an order already accepted under the promotion.

14. Intellectual Property

Unless otherwise stated, the text, photographs, videos, graphics, logos, jewellery designs and other content appearing on the CL Jewellery website are owned by or licensed to CL Jewellery and are protected by applicable intellectual property laws.

You may view the website and use its content for personal, non-commercial purposes.

You must not reproduce, publish, copy, modify, distribute, commercially use or otherwise exploit our website content or product photographs without our prior written permission, except where permitted by law.

15. Customer Reviews, Images and Submissions

If you voluntarily submit a review, photograph, testimonial or other content to CL Jewellery, you confirm that you have the right to provide that content.

We will not use identifiable customer photographs or personal information for marketing purposes without appropriate permission.

Where you give us permission to publish submitted content, you allow us to reproduce and display that content for the purposes agreed with you.

16. Website Availability

We make reasonable efforts to keep our website accurate, secure and available.

However, we cannot guarantee that the website will always operate without interruption, technical faults or errors.

We may update, modify, suspend or discontinue parts of the website where reasonably necessary.

Nothing in this section limits liability that cannot lawfully be excluded under New Zealand law.

17. Privacy

Our collection and use of personal information is governed by our Privacy Policy and applicable New Zealand privacy law.

Please refer to our Privacy Policy for information about how we collect, store and use personal information.

18. Electronic Communications

You agree that we may communicate with you electronically in connection with your enquiry, order, delivery or customer service request.

Electronic communications and transactions may have legal effect in accordance with applicable New Zealand law.

Marketing communications will be sent in accordance with applicable New Zealand electronic messaging laws and, where required, will provide an appropriate method for unsubscribing.

19. Liability

To the maximum extent permitted by law, CL Jewellery will not be liable for indirect or consequential losses arising from circumstances outside our reasonable control.

Nothing in these Terms and Conditions excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded or restricted, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

20. Business Purchases

If you acquire goods or services from CL Jewellery for business purposes, different rights may apply under New Zealand law.

Any agreement to contract out of provisions of the Consumer Guarantees Act 1993 or Fair Trading Act 1986 will apply only where legally permitted and expressly agreed in writing.

21. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes to our business, website or legal obligations.

Any updated version will apply from the date it is published on our website.

Changes will not retrospectively alter an order or contract already accepted unless the parties agree otherwise or the law requires it.

22. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.

Any dispute arising in connection with these Terms and Conditions will be dealt with in accordance with New Zealand law and, where applicable, by the New Zealand courts or tribunals.
